Honestly, you just have to strike them—break every bone if necessary—rather than trying some fancy leverage technique or whatever else... it’s a good thing they didn't suggest just shooting him on sight immediately, right? I can't tell if this was written by Kirk or if it was somehow added later as an important note, but from where I'm sitting, a blunt strike is anything but "minimal force."

I only brought it up because everyone seems obsessed with using leverage or specific holds, when according to the law, a physical strike might actually be the required response. Maybe the officer misjudged the situation? But I mean, trying to apply a technical hold on some drunk, aggressive punk... that's just asking for trouble.

D. The amount of force used has to be proportional to the severity of the offense and the specific legal goal being pursued (basically, use the least amount of force necessary to get the job done)

I think you’re totally misreading how the law actually works—I mean, just because strikes are listed first doesn't mean they're the go-to move. It's just a list of options, not a step-by-step manual, you know? You really have to look at it through the lens of section D.

B. A police officer will exercise their authority to use physical force against an individual by applying:
1. a strike
2. a restraint technique
3. other defensive or offensive maneuvers intended to compel compliance while causing the absolute minimum amount of harm.

IMPORTANT: always start with the least amount of force and the mildest means available (like a strike instead of a restraint technique)

So, apparently, you're supposed to just deck him and break every bone in his body instead of using a leverage hold or some kind of restraint... honestly, it's a good thing they didn't write down that he should just shoot him on sight immediately. I can't tell if Kirk wrote this or if this "IMPORTANT" part was tacked on later—because, in my humble opinion, a punch is definitely not the "mildest" way to handle things.
How to change my avatar and signature? in Forum Help! ·
In order to accept POST request originating from this domain, the admin must add this domain to the whitelist.

So, first off, I couldn't even get my avatar or signature to work—not a chance—so I just started this thread... and now? Now I can't even change them if I wanted to. Every single time I try, I just get hit with that annoying error message up top. I'm uploading everything directly from my PC, and yeah, I checked—the images and signatures are the right size and everything. I mean, seriously, am I supposed to have to bug the admins every time I want to tweak something, or is there actually a way to just fix this myself like a normal person?

an intoxicated individual actually poses less of a threat than someone who is stone-cold sober

Well, I suppose that all depends on whether or not they are carrying a weapon, because if you have some drunk person running around with a handgun spraying bullets in every direction, the courts might actually try to pass off their intoxication as a mitigating factor—claiming they weren't in their right mind or whatever—but honestly, give me a break. Our entire judicial system and sentencing guidelines are such an absolute farce that it feels like something straight out of Monty Python; it really isn't any surprise that you see graffiti mocking the American legal system everywhere you look.👎

Self-Inflicted Insanity

Section 41.

A perpetrator is not considered legally insane if they voluntarily brought themselves into a state where they couldn't understand the nature of their actions or lost control of their will due to alcohol, drugs, or other substances—provided that at the moment they entered that state, the crime they committed was something they intended to do or showed a reckless disregard for, assuming the law provides for punishment under that specific type of culpability.

So, I had this one encounter back in the States where a cop actually slapped me—just straight up swung at me—all because I talked some trash back after he started being incredibly rude and insulting me right in front of his partner. Like, seriously? What would have happened if I’d actually fought back? Just imagine who’d be writing the official report and what kind of nonsense they’d put in there!

Look, try insulting a cop over in Germany instead. They’ll probably just give you this polite little smile while they jot down every single word you said, but let me tell you, once that massive fine hits your mailbox, you aren't gonna find it funny anymore. And god forbid you even try to lay a finger on them... suddenly, it's all your fault.
