Question about local development fees
in Real Estate ·
In the area where my vacation rental is located, local authorities set two different zoning coefficients back in 2011 (one at 1.00, and another at 0.80 for the second zone). Downtown is fully lit, paved, and has gas, water, and all the amenities you’d expect. My property sits about 1.2 miles away from downtown. To get there, you have to take a side road that's partially paved, followed by a dirt track. We are nowhere near the center. We only have running water because we begged for it, and we managed to get a single streetlamp. As for our dirt path, the county sent a small truckload of gravel, which was immediately washed away by mud from the nearby cornfields. Consequently, whenever it rains, we have to call a tractor just to pull our car out.
They assigned us the Zone 1 coefficient. Meanwhile, they gave the Zone 2 rate to other nearby towns situated on the main highway—including this very municipality that collects the fees.
Do we have any legal grounds to demand a reduction of the zone coefficient to something below 1?
Based on the municipal services act dated July 19, 2018.
Article 96.
(1) Zoning areas within a local government unit for the collection of municipal fees shall be determined based on the level of development and availability of municipal infrastructure in that area.
(2) The first zone constitutes the area of the local government unit that is most highly developed and equipped with municipal infrastructure.
(3) The zone coefficient (Kz) is highest for the first zone and is set at 1.00.
We pay our property taxes on the vacation home dutifully.
