Thinking about taking the TOEFL? in Law ·
Frank Walker7 said:Oh, don't be so hard on yourself!
To me, it makes perfect sense, because when you're working as a certified interpreter, you aren't just translating legal jargon—you're translating everything from technical manuals to medical reports.
So, having an International Chamber of Commerce certification is great for contracts, much like how specialized medical or construction terminology helps when you're handling expert witness testimony,
And I've always felt that a CPA qualification covers all those subtle linguistic nuances, so it seems to me that someone with that background might actually have a bit of an edge over someone who just has a standard CPE.
Anyway, I'm probably just overthinking things... besides, you have to shell out five grand just for the interpreter training anyway.

Finding a well-paid junior interpreter out in a coastal city like Miami is practically like hunting for a unicorn these days.

🤣

well, well 😁

Anyway, my office is going to be spitting out a massive amount of $1333 for legal translations from English this week... boom...

I definitely need to start studying for Comcast as soon as possible.🙄

I have a question—it might sound a bit trivial or even naive—but I’ve been staring at these bank websites trying to decipher their terms and conditions, and frankly, I’m more confused than when I started.

I am looking for a card (it doesn't necessarily need to be a credit card) that meets the following criteria:

1) The ability to withdraw cash from ATMs without being hit by extra fees. This implies a wide network of machines, so I assume big players like Chase or JPMorgan Chase would be the go-to options here.

2) The option to set up installment payments.

I don't need an overdraft line, and I have no intention of traveling internationally.

However, life isn't always simple. My paycheck is currently deposited at Bank X, and I am unable to switch my direct deposit to a different institution (please, don't ask why 🙄). Additionally, I don't actually live at the address listed on my ID right now; I'm staying somewhere else. Will that cause any issues with the application?

Is there any hope for me? 😁

Starting an LLC: Where to begin? in Business, Accounting & Taxes ·
Why not just start a secret society?
Essentially, this individual funds you—providing capital, property rights, or whatever else is needed—and in exchange, they take a cut of the profits. Since a secret society lacks formal legal standing, it won't show up on any state business registry. On paper, you remain the 100% owner of the LLC or whatever entity you decide to establish. In reality, a secret society functions more like a private contract between two parties. As far as the rest of the world is concerned, you are the sole authorized representative of your firm.

As long as the connection is encrypted and you are purchasing from a reputable server, there really aren't any issues. Regarding card fraud, a waiter at your favorite local diner could skim your card just as easily when you're paying the bill.😎

The second tier consists of the surviving spouse if there are no kids, followed by the parents.
There are also third, fourth, and other tiers of succession.

I don't see why we're even debating this here. Nobody has died, so there's no probate or inheritance laws to apply, and nobody's even filed for divorce.
This is about a car. The father and son are too chicken to just take it back, so instead, the daughter-in-law swiped the keys. Now they're scrambling for a way to drive it because she’s been the one driving both of them around up until now.🙂

Furthermore, they are well within their rights to exercise self-help. 😬
Matthew King9 said:If that's the case, why does the law state they belong to the first tier😉?
And then list siblings and their spouses in the second?

Where on earth did you find that? Which specific law are you referencing?

The primary line of succession consists of:
The decedent's children, adopted children and their descendants, and the surviving spouse.

I need some assistance here. I'm trying to send a private message to a woman on this forum, but her inbox is completely full. She doesn't check the site very often, and I'm in a bit of a rush because I purchased several items from her on eBay, and I need to settle the payment ASAP to avoid receiving any negative feedback.
Is there any other way to get in touch with her? There isn't an email address or anything similar listed on her profile.

It turns out it’s all about $13, though not quite in the way you'd think—it isn't actually for opening a foreign currency account, but rather for closing one, where those $13 or their equivalent value have to remain sitting in the balance at all times. There aren't any monthly maintenance fees to worry about, though I should mention that my card won't be arriving in three weeks like they promised, but rather in four.

I had $13 in my account and I simply could not get the PayPal authorization to go through. Eventually, a woman from the card department informed me that I needed to maintain a minimum balance of 100 or $40 in the account. Once I added another $47, everything worked perfectly.

Not really; all their cards are processed through Germany, so there isn't any way to speed things up....

bluerider2 said:There isn't really an option for a replacement because there isn't even anything to replace. I actually went ahead and handed back my High Electron card today and closed out my foreign currency account over at JPMorgan Chase.

The issue with Zaba is that they only offer a High Electron card with a sixteen-digit number printed right on the front, but if you flip it over, there aren't any numbers or even a verification code near the signature. Their version of the Visa Electron just isn't set up for online shopping at all.

I suppose I am feeling a little relieved that they released my funds without trying to charge me a monthly maintenance fee for the ten days I held that account open.

I spoke with someone at Wells Fargo over the phone who assured me that their Visa Electron cards do include a CVV, though I tend to be a bit skeptical until I see it with my own eyes. It seems much more user-friendly over there since they don't charge for account maintenance—you just pay a one-time fee when you first open the account.

$6.75, you're waiting three weeks for a card. You might as well just open the account now, because their cards definitely have a CVV. I use one of theirs and everything runs perfectly fine on PayPal.😬

Does Zaba even issue debit cards that come with a CVV code? 😕
Generally speaking, you can certainly ask, though you will likely have to wait about three weeks for the card to arrive, and you'll be responsible for covering the issuance fees.

Don't bother with the reporters; they're nothing more than self-proclaimed experts who don't know a thing.

I am not attempting to defend the media, as I am well aware of the nonsense they publish, but the court reports in the New York Times are supposedly authored by individuals with actual law degrees.

Arthur Barnes said:That being said, can you address my point regarding the likelihood of the criminal element recurring—bearing in mind that such a change would necessitate amending the Constitution, the Penal Code, and various other legal frameworks?

Well, when it comes to the distinction between countable and uncountable quantities, experts are still debating the issue today. Dozens of books and academic papers have been written on the subject, and as a student, I certainly don't consider myself qualified enough to intervene in such matters.🙂
To put it simply, the presumption of innocence in criminal law functions as an absolute dogma; it is not something one touches.

Arthur Barnes said:If a person with a cognitive disability goes around firing a pistol, and then is released because they aren't held culpable, only to repeat the act a thousand times over, where does that leave us?

But that is precisely the point. Because the individual isn't held legally culpable, they won't end up in prison, but they will be committed to a psychiatric hospital. They aren't simply set free. It is somewhat difficult for me to explain this clearly.
😬

Arthur Barnes said:When it comes to measures like this, I truly don't see why people who are incompetent should be exempt from such treatment.

To explain this simply, it contradicts all fundamental principles of criminal law. I will attempt to summarize it concisely, though it is not a simple task. 🙂
In short, for an act to constitute a crime under the US Penal Code, four specific conditions must be met:

1. ACT – For a crime to exist, there must first be an act, defined as a voluntary human action. Therefore, any effects caused by natural forces or animals are excluded from this concept. Human activities or states of being are also excluded; mere thoughts, beliefs, character, or lifestyle do not qualify. Physical movements that occur outside of a person's control are not considered acts.

2. An act that matches the legal description fulfills the ESSENCE OF THE CRIME. This term refers to the total set of characteristics that define a specific offense. The essence contains everything typical of a particular crime.

3. For behavior to be considered a crime, it is not enough to merely fulfill the essence of the crime; the act must also be UNLAWFUL.

4. Unlawfulness alone is insufficient for a crime to exist; one must also establish guilt principle

Guilt is our most critical factor. Consider this:
guilt = the subjective relationship of the perpetrator to their act, which allows for the issuance of
blame.

The guilt principle = NULLA POENA SINE CULPA (no punishment without guilt).

Under Section 4 of the US Model Penal Code: "No one can be punished, nor can other criminal sanctions be applied to them, unless they are guilty of the committed act."
The guilt principle combined with the principle of legality forms the foundation of modern criminal law.

THE NORMATIVE UNDERSTANDING OF GUILT IN MODERN US LAW:
Section 39 of the US Penal Code states: "A person is guilty of an offense if, at the time
of the act, they were ubrojiv, acting with
INTENT or NEGLIGENCE when the law prescribes
punishment for that specific form of guilt, and they were AWARE
or were DUTY-BOUND and ABLE TO BE AWARE that their
act was PROHIBITED."

Three elements of guilt must be satisfied:
1. UBROJIVOST
2. INTENT or NEGLIGENCE
3. AWARENESS OF UNLAWFULNESS or THE POSSIBILITY OF SUCH AWARENESS

In this context, ubrojivost is our primary concern.

Section 40 – An individual is neubrojiv if, during the commission of the legal elements of a crime, they were unable to understand the meaning of their actions or could not control their own will due to mental illness, temporary mental impairment, insufficient mental development, or another severe mental disorder.
The legal consequence of being neubrojiv is that no criminal sanction can be applied to the perpetrator.
However, criminal proceedings are still initiated against a neubrojiv person, as neubrojivness can only be established through a judicial ruling. Following the verdict, if the individual poses a direct threat to their own life or the safety of others, provisions regarding involuntary commitment to a psychiatric facility will be applied.

To summarize: A person who is neubrojiv lacks guilt; without guilt, there is no guilt, and therefore, no crime.
