From what I gather, the motion for enforcement has to be submitted within a year after the payment deadline. Once that passes, the statute of limitations kicks in.

If you use a little elementary school math, the motion for enforcement should have been filed BY 2008 (we don't know the exact date), which begs the logical question: what exactly have our American legal institutions been doing from 2008 until now, assuming the motion actually was filed on time?

Honestly, it’s no wonder the government is such a mess when a single basic enforcement case drags on for six or seven years...

Personally, I’ve had a garnishment sitting with a notary since 2007... though the actual thing dates back to 2005 or 2006. And even now, they’re still just waiting. They haven't even frozen my account, so I guess interest isn't even accruing yet??????

Even here on the forums, someone is claiming that the statute of limitations doesn't start counting from the moment we actually realize something is wrong... I honestly don't follow their logic at all. If that were true, would I need to file a formal motion regarding the statute of limitations and send it over to the court?

I’m not actually talking about utility bills here... I mean AT&T.... specifically mobile debt... do you happen to know anything more about how they handle that?

Jerry Gray said:I went through a few pages before this and figured it was just a statute of limitations issue. The bills were from December 2011, January 2012, and March 2012. Then the seizure notice was dated September 16, 2013, and I signed off saying I received it just a couple of days after that.

Hanžeković & Partners

I guess I'm not even sure if it's actually possible to fight back against these big corporations and greedy sharks...

And me, Hanžeković... did they just target you specifically, or what?

There should be three dates on an enforcement motion, right?
First, the date someone typed it up, copy-pasted it, or otherwise drafted the motion. That's the creditor's date.
Second, the date the court, the notary, or some other third party with authority stamps on the front of the motion to make it official. A judge or notary puts this one on.
Third, the actual date the enforcement order is issued. Again, that's the court or notary's doing.

I've dealt with three different cases now where that second, most critical date was practically missing. How is a debtor supposed to calculate the statute of limitations without that date?
😉
Interesting, isn't it? Someone's trying to pull a fast one. I wonder if people are expected to know about this "minor detail" when filing objections, given how often they use the excuse that "ignorance isn't a defense." 😉.
In all three cases, the principal amount was eventually paid, just late.

So, my suggestion for these people: file the objection for the statute of limitations or not? If that second date exists, I'd tell them immediately which legal fees they're stuck paying.

Regarding that second date... what do you think, John Clark6?? If you aren't sure, PLEASE, if you have the time, look into my situation too...

Jerry Gray said:hmm.. I guess I'm in a similar boat with T-Mobile... Isn't the statute of limitations for telecom services just one year?

I heard today that it’s a one-year limit too... which law firm ended up suing you?

Come on, give us the breakdown... explain how this math actually works. I was served with an asset seizure order back in 2007 and, honestly, I haven't seen a single thing happen since then...

John Clark6 said:No, plus you've already got that whole thread about legal judgments and collections

What do you mean by that? Care to elaborate a bit...

I have a bit of a question... I'm dealing with a massive judgment and an asset seizure order from AT&T dating all the way back to 2007... yet they still haven't frozen my bank accounts?? Why is that? Is there any chance it's hit the statute of limitations? I've heard somewhere that things expire after five years or something like that...

Hey everyone... I have a quick question if anyone can help me out... Basically, I’ve been dealing with a massive judgment from AT&T dating all the way back to 2007, and yet my bank account hasn't been frozen even to this day... Is it possible that the statute of limitations has run out? Thanks...
