Traffic violation procedures in Criminal and Misdemeanor Law ·
Quick question about a parking ticket I just got from some officer. He left me a "citation" and a payment slip. Here’s the deal: if I decide not to pay, am I looking at a court summons or just some ruling sent directly from the courthouse? Since I'm a broke college student with zero income right now, I'm actually planning on trying to swap this fine for community service instead. Does anyone know when or how I should even propose that?? I tried Googling it and digging through various forums, but it's such a headache because our laws in the US seem to change every five minutes, so I have no clue what the current procedure is... 🙂

So, I just got caught running a red on the bypass near Plate because of those bridge construction zones. There was this massive semi-truck right in front of me that also blew through the red light. The stretch between the two signals is about 1.5-1.2 miles miles long and goes right through a residential area. There aren't even any "no stopping" or parking signs posted anywhere. Here’s my issue: the cop car wasn't even behind me; they were parked somewhere in the middle of that stretch. How on earth can they claim they "personally observed" me blowing a red? Will the Supreme Court actually listen to my argument that I entered on green, but then had to pull over into the first available spot within that zone to take a quick phone call? Since I had already passed the light, I couldn't see what color it was anymore, but since that truck ahead of me was moving in the same direction, I figured it had to be green. About 500m after following that truck, the cops suddenly pop up out of nowhere and pull both of us over to write us tickets (I've got two witnesses who can back me up on this). What are the odds the court tosses this, considering the cops parked in the middle of that block can't possibly know which light was active at the entrance or exit 😕

Hey there. Sorry if this has already been asked, but I figured I’d throw it out there just in case:
How often does it actually happen in the real world that the cops appeal a court ruling? Specifically when the sentence handed down for a misdemeanor is lighter than what they originally pushed for. In my case, I got hit with a judicial reprimand for a DUI, even though the prosecution was asking for a three-month license suspension and God knows what else... My 8-day window to file an appeal starts today, so I'm just wondering—what are the actual odds that the police are going to appeal this???

Back on November 16, 2006, I got busted for a DUI with a 1.5 BAC. Since I was a rookie driver at the time and it was after 11 PM, things got messy. Apparently, because of how the "intervention" went down, my case just sat at the bottom of a drawer at the local Police Department for years. Then, out of nowhere on February 15, 2008, a summons for court shows up at my house. My cleaning lady opened the door and refused to take it, telling them I wasn't around because I was studying in San Francisco (even though I’m not officially registered there!). So today, on my dad's suggestion, I finally head down to the courthouse. I check in with the clerk to get my hands on that summons (the hearing was supposed to be Feb 22, 2008), but the clerk basically gives me the runaround. He tries to pull my file, but he can't find it. He checks his logbook and realizes there wasn't even a single hearing scheduled under my name back in February. Here’s the kicker: I saw on the computer screen in the office that this is literally the only case they have on me. I even asked the judge if maybe an arrest warrant had been issued, but neither him nor the clerk had anything on record...

1. Did I actually gain any time by them not being able to find my file?
2. Is it even possible for an arrest warrant to exist if nobody in the system knows about it?
3. Does the whole process just reset when the judge reschedules the hearing (like, does it go first notice, second notice, third notice...) or does it work differently???
Thanks 🙏🙏🙏

And how exactly are they going to force me to travel all the way down to Savannah for court? BTW, I’m studying in Miami, but my permanent address is somewhere else. Does that even matter? Can I file an appeal or some kind of formal objection? Just to be clear, I haven't signed anything, and I haven't even received any official notice about the citation yet...

And what about down in Savannah? I mean, shouldn't I be heading to the court where I actually live...

So, I just got caught running a red light at a mobile signal. The cop pulled me over, took my license and registration, and told me I’d be heading to court in Mobile since that’s where the violation happened—even though I actually live way up in Savannah... I was just driving back home. Is it even possible for me to get a summons? The officer didn't actually write up a formal report right there, show it to me, or ask for my signature; she was just jotting stuff down in some tiny little notebook or something... Any idea if this holds up? Thanks in advance😉
