This whole mess goes back to February 2008.
So we're talking four years, if I'm remembering right—but from what date exactly? Are we counting from this new Supreme Court ruling, or that old decision from the Misdemeanor Court?
Everything is calculated from the date the offense was actually committed.
So, here’s the situation:
About two weeks ago, I got pulled over and the police clocked my BAC at .054. I didn't sign anything on the spot, so now I'm just sitting here waiting for the court paperwork to arrive. What am I looking at? I have a completely clean record—no prior offenses or anything.
I took a look at the updated statutes, and frankly, the penalties seem absolutely draconian. We're talking $1,000 $0.00, a two-year driver's license suspension, and even potential criminal charges...
It all feels incredibly heavy-handed to me. I was wondering if anyone here has had experience dealing with these new laws? I'd love to hear about what actually happens in court and how judges are handling these cases lately.
Thanks,
