Yesterday my sister-in-law got slapped with a $167 fine for using her phone while driving. The officer handed her the citation, but she didn't sign it. From what I understand about contesting a ticket, you file an objection with the local Police Department that issued it within 8 days... or if that doesn't work, you appeal the court's decision once it's handed down. Is that how it works?
One more thing... a few months back, she got hit with a speeding ticket in a residential zone for $333 (she was going 31 miles mph over the limit). She hasn't paid that one, nor did she contest it.
So now she's wondering what the move is. Should she fight this new cell phone ticket, or just pay it and wait for the court ruling on the old speeding ticket so she can appeal that instead? What’s the smarter play here? Is there any chance a judge would lower the amount or even toss the whole speeding fine if she isn't technically flagged as a repeat offender, especially if she pays the $167 fine? Or is it better to just refuse to pay anything, wait for the court order, and then appeal everything to drag out the process in hopes of hitting the statute of limitations?
What's the actual practice in cases like this? Just noting, she has no prior driving record before that speeding violation.
Thanks in advance!😁
