Her only real priority is finding a loophole to dodge that fine. She couldn't care less about the police officers themselves. Now, the only question left is what her next move will be.
Here is the situation:
Earlier this year, during her third month of driving, my girlfriend was heading home from college. As she was turning off the highway onto a local street, the police pulled her over because they noticed she was on her phone while driving. Once they ran her information, the same officer approached her vehicle and told her straight up that she shouldn't be messing around with a car that powerful. He advised her to just wait out the next month until her probationary period ended and warned her to stay careful, otherwise, they might extend her probation.
After checking her credentials, the officer let her go without issuing any citation or paperwork for the violations.
The officer released her without providing any official notice of an infraction.
Fast forward more than four months, and she just received a citation in the mail for both using a cell phone while driving and operating a vehicle with more than 175 horsepower.
Now I am trying to figure out our best course of action.
Should she plead guilty to the offenses but file a formal complaint regarding the officers' conduct? If she files a complaint, is there any actual chance those individuals in uniform will face any kind of disciplinary action?
Or
should she draft some sort of legal appeal to try and get the fine dismissed entirely?
I am hoping for plenty of responses... thanks...
