Wage garnishments and collections in Law ·
hollowmason64 said:Well, did it ever occur to you that they do that to protect people from being sued over money they already paid back?
I actually went through this myself... luckily, her mom insisted we put down in writing exactly how much cash I had handed over (this friend was traveling abroad at the time), and we literally just scribbled it on the corner of some random folder.

To me, the rule about the bank not releasing seized funds within 60 days makes way less sense. Waiting 30 days felt like an eternity 🙄

It might seem pointless if you ignore the fact that the IRS doesn't actually verify whether those seizure documents are even legit.
We’ve had cases where people got hit with seizures based on completely forged paperwork.
All someone had to do was type up some nonsense on their laptop that looked official, slap on a fake stamp, and hand it over to the IRS.

The IRS doesn't give a damn—they just freeze the money and leave the debtor to struggle however they can to prove the document is a total fraud.
Trying to prove that in 30 days? Practically impossible. 60 days feels like a much more reasonable window. (And look, you have to consider how slow things move in this country and all the hoops you have to jump through at different government offices).

But hey, you aren't going to see this reported on the news or discussed on TV. You only hear stuff like this at industry seminars from people who actually work inside the IRS. 😁

Like, his boss could be forced to divert a third of his paycheck straight to me to cover this debt, which would technically jump me ahead of everyone else. Or, I guess, there's the logic that since my debt is older than the others, I should naturally be first in line anyway, depending on how the dates shake out.

Honestly, I don't have any beef with him right now; I'm still playing dumb and just sitting here listening to him whine about how he'll pay me back the second he gets the chance.

I actually stumbled onto all this because I'm pretty tight with his father-in-law—we used to vacation together back in the day—so I ended up recommending him to some friends for a summer trip.

Then they tell me they aren't even sure yet if they're staying at his place or at his father-in-law's place in Washington, D.C., since he also runs rentals for him.
And yeah, he only has one father-in-law.😁

The best part is, he's been paying me under the table most of the time; I might have like two actual bank transfers to show for it. He knows I'm too much of a pushover to drag him through the mud, which is why he keeps acting like we're cool.

Personally, I think I'm gonna be totally blunt with the lawyer about how much cash I've already received under the table. I might even list those discounts he gave me back when he ran his own business as part of the debt repayment, just to keep everything transparent. I don't care—I just want him to learn his lesson and pay back what he owes, even if the amount isn't massive (around $4000).

We signed a contract back in 2008 where he promised to settle everything within two years, and if I remember correctly, the statute of limitations is ten years.

Look, "administrative ban" isn't even a real legal thing anymore. It’s just old-school slang people still use, but what they’re actually talking about is a wage garnishment or some other recurring deduction from your paycheck.
For an employer to actually pull a garnishment on your wages, they need a legitimate legal document—like a signed consent form from the debtor—to make it stick.

If you want to see how that consent form is supposed to be laid out according to the federal regulations:

Take a look over at http://ec.europa.eu/taxation_customs/tic/
to see what kind of rules Austria is running with and if they actually met them.
Also, who knows? You might have just been under the threshold for an IRS refund 🤔

Robert Sanchez6 said:If an employee wants to retroactively add a family member to their coverage, they can only do so via the Medicare online portal.
The application seems to have been down since February 17th—apparently, they issued instructions to handle everything via paper forms at the local service counters instead.
My only concern is what you mentioned regarding filling out the T3 form. Is it possible you used an outdated version or perhaps filled out the wrong one by mistake? Currently, there are only the T1 forms (for the employee) and T2 forms (for dependents).
If we are talking about a child under 18, there are actually two paths available: independent coverage or being covered under the primary policyholder—in this case, the employee.

I just filled out the form I found sitting in the filing cabinet 😁—it had a section for family members on it, so I figured 😁that was the right one.
The coworker who actually knows this stuff is home with the flu, and honestly, this isn't really my area of expertise.

Anyway, the employee hasn't come back to check in. Guess he got it sorted.
I didn't see any notice about this on the Medicare site yesterday, even though I spent way too much time digging through it 😵

Thanks for the heads-up. I’ll send someone out today to pick up those specific forms you mentioned. Whatever works.

I’m pretty sure I can’t just add a family member to my health insurance through the pension portal; I actually have to go through the Medicare site, right? Or am I just overthinking this?
I really don't feel like calling a colleague back home to ask, especially since my wife is currently on a forty-minute silent treatment streak and barely even looks at me. Honestly, I'd rather be suffocated than deal with that kind of tension right now. 😉

It’s been 8 days now 😲
And they seriously can't manage to put a simple notice on their own website? I guess that's just too much high-level rocket science for them. 👎
Total nightmare! I’ve been sitting here losing my mind, thinking I was the one messing something up. 🙂

Honestly, these government agencies... zero accountability, zero common sense.

Help me out here, people 🙂
A colleague who handles all our enrollments and cancellations came down with the flu, so I had to jump in and handle a family member's enrollment through Medicare myself. Long story short: the system completely tanked on me.

Normally, we have everything set up so she can just breeze through it all online, but since she’s out sick and this was an emergency, I had to step up and try to fly solo. 🙂
I couldn't even get the online portal to load. I eventually lost my cool, gave up on the tech, and just filled out a paper Form 3 for the guy, telling him he’d need to take it down to the local office and try his luck at the service window.

What happens if they won't accept the paperwork at the counter? Is the whole digital system actually glitching out right now, or am I just losing my mind and doing something wrong? 🤔

Look, I’m pretty sure the sales tax is already baked into that receipt. It was paid over in Austria, so that's the Austrian restaurant owner's headache, not yours. You aren't even showing it here.

Sarah Sullivan3 said:Hey, could I get a quick hand with something? Just trying to double-check... if I've got software on a CD coming from the USA, does that count as goods or a service on the sales tax return?

It's a service, plain and simple. Goes right under Section 26, subsection 4 (b) of the Sales Tax Law.

Chrome and Mozilla keep telling me no certificate was selected, and IE 10. keeps throwing this error

image

I followed every single step in the manual to stop this from popping up, but nothing works. At this rate, I might as well go out and buy a whole new OS, since XP is ancient and won't even let me update to IE 10.

Now I’m starting to think maybe the USB stick or the certificates themselves are corrupted or something—who knows. What’s the deal with getting them reissued? Do I have to file some kind of formal request or what?

thanks

Forget about reissuing certificates. Just call their support line; they'll walk you through it step by step. You definitely missed something small somewhere along the line.

Honestly, I'm flying blind here because I haven't even seen the invoices. It’s hard to give you a straight answer without seeing who actually issued them, whose name is on the line, what kind of service we're even talking about, where the tax nexus sits for that specific job, and whether every single one of those receipts actually checks all the legal boxes required by the IRS.

swifteagle12 said:Wait, if those accounts don't have sales tax on them? Then am I just getting hit with an extra sales tax charge?

Whoa there! Let's pump the brakes and take it from the top. Honestly, your first question felt a little off given the services you were talking about, but now things are just getting weirder. 🤔

When you're filling out your sales tax returns or the reverse charge forms, you only list the invoices where the tax liability actually shifts onto *you*. We're talking about those specific bills that show zero tax because they include a mandatory note stating the tax obligation is being transferred to the buyer under some specific section of the US tax code or federal guidelines.

If you've got invoices where they already calculated and charged their own local sales tax, that absolutely does NOT go on your sales tax return—not even on the reverse charge forms.
Sales tax from other states or foreign countries doesn't get lumped into our domestic filings. If you want that money back, you usually have to go through a formal VAT refund system or a state-specific tax credit process.

swifteagle12 said:These accounts date back to 2014, and most don't even show sales tax, so I gotta double-check everything once I get into the office. Most of these bills are just for services, like using a password for web searches via NPR

A password for web searches via NPR??? Are you talking about a subscription to an NPR digital journal or something? There's no way that's an invoice from some random company based in another USA state.
Doing business with USA member states in Business, Accounting & Taxes ·
What am I even looking at on those invoices? Is the tax liability actually sitting on your shoulders now, or is it just some random sales tax they're tacking on? And for heaven's sake, what year are we even talking about here?
Doing business with USA member states in Business, Accounting & Taxes ·
What does it actually say on those invoices? I mean, did they even pass the tax liability over to you, or is it just some random sales tax tacked onto the total?

Look, if you haven't filed your sales tax return for January yet, and that shipment actually landed in January, then just stick with the 01/31 date.
But, if you already hit "submit" on that January filing? Forget it. Just book it under 02/06 and roll it into your February taxes.
Doing business with USA member states in Business, Accounting & Taxes ·
Douglas Nguyen30 said:The goods were officially transferred on January 31st, we have the shipping documents in hand, but the invoice isn't dated until February 6th, 2015. Should I record this transaction in January using the exchange rate from the end of the month—meaning it hits the January VAT return—or wait until February 5th for the February filing?
Thanks so much!
