Yeah, that’s exactly how I read it in the IRS filings back in 2013. They actually told me today that’s the way to go—even though the Police Department put out an opinion on 02.11.2015 saying otherwise.

When I showed them that Police Department opinion, they were just like, "Oh, yeah... that's new, do it that way."🙏

But it says things should be done differently here🙏—basically the way I laid it out above...

Can someone just double-check if I’ve actually got this three-way deal straight?
A - Poland, B - Canada, and C - USA

Company A delivers the goods to C, but sends the invoice to B
Then B invoices C for those goods

Since I'm at the end of the chain, I'd be putting this in my sales tax return under Section II.13—received goods and services from non-resident taxpayers at the 25% rate—Section III.13 for input tax from non-residents at 25%, and Section VIII.6 for goods received from the USA as part of a three-way transaction

I'm assuming I don't list this on the standard sales tax form... but since the inventory is physically hitting the US, I guess it counts as an interstate move... right?

Two clerks actually tried to corner me on the forum just to keep me in the dark...
I just shot them an email with the full list of attachments I sent—basically told them to go check it out with their IT department...
They haven't said a word since then...🐔

where I just finished, everyone was totally messing up and nobody did a thing about it...
they were actually reporting it right in the VAT forms—you know, the IRA and URA ledgers—they just weren't showing it in interstate transactions.
the second case? they acted like the acquisition happened right here in the States, skipped registering in Canada and all that 😁
I'm honestly torn on what to do about the previous stuff—is it even smart to poke the bear or should I just let the App 🤷 I don't know, this App
is just pulling at me more...

Spot on—that’s exactly how I figured it out too... basically, it just comes down to who’s listed as the exporter on the JCD so everything lines up in our domestic records...

Since nobody seems interested in a deep dive, here’s what I’ve figured out...

Case one.
Company A isn't showing any EU acquisitions on their US VAT returns or regular tax filings—mostly because the goods never actually hit US soil—so nothing shows up in Intrastat either. Plus, Company A doesn't list any exports on their VAT forms since Company B was technically the one handling the exporting. On their outgoing invoices, Company A just marks everything as VAT-exempt under Section 4 of the local tax code.

Case two.
Company A actually has to register for VAT in Canada because that's where they're picking up the goods. From there, they handle exports from Canada to Mexico, all being VAT-exempt per the Canadian Value Added Tax law.

On the first page of the sales tax form, there’s usually a section for explanations or whatever... I just type in why I’m filing an amendment right there and it’s always worked fine for me...

I’ve dealt with this twice now... I basically wrote up an explanation saying my supplier totally botched the paperwork and handed it over to the agent—plus copies of everything from the office... honestly, I bet we're the only ones actually doing this kind of legwork... what am I supposed to tell them? My supplier claims it was some complex three-way deal when it really wasn't... they can go explain that mess to their own local IRS if they want... it feels like they were just waiting for us to join the USA so they could finally start nitpicking our books since they don't have enough of their own nonsense to look at anyway...
One of my suppliers dated an invoice June 24th, 2013, as a tax liability transfer, but we didn't even enter the US system until July 1st... so now I'm stuck trying to explain things to some lady at the IRS who's demanding bank statements and copies of office docs 🙂 obviously, it went through on our end as an import—I've got the customs entry and the freight forwarder's invoice right here—but seriously, why do they need me to send over the actual bank statement too...

Now the Treasury is blaming the IRS application and Java, and they're just passing the buck back and forth.

Personally, I'm starting to think that their DLL just isn't compatible with Windows 8, or at least not fully.

Is anyone else actually getting the IRS site to work on Windows 8? Does anyone have a clue where I should even start looking for a fix?

So, a coworker was just telling me about that whole Windows 8 headache—someone from her firm actually hopped on via TeamViewer and spent like six hours straight trying to fix it... Apparently, the issue is that their specific software won't run on Windows 8, so this guy ended up hunting down compatible versions from all over the banking sector until he finally found one that works for the IRS site... I didn't really have much to add, but honestly, maybe just give her firm's tech support a call and lay it out for them? They might realize the glitch is actually on their end... 🤷

Just wipe Java clean and then reinstall version 7u20—that’s what I’m running and everything works like a charm...
