Hey everyone,

Got two quick questions to help out a colleague of mine.

1. Does the HROK show every single debt, or just the stuff that’s gone bad? Also, can you tell if someone is listed as a guarantor?
2. When did the HROK actually start being used?

Here’s the deal: about 20 years ago, my friend signed some paperwork to act as a guarantor because someone told her they were backing out of a loan right after she signed. Now she’s stressing about whether that actually happened, but since things are awkward between them, she can't exactly ask.
Then, about 15 years ago, she applied for a loan herself. The lady at the bank told her everything looked good, except for a small overdraft and a tiny bit of leftover debt on her MC that needed clearing first. She settled it, and the loan went through. I’m wondering—does that mean the old guarantee wasn't real? I doubt they'd approve a loan if she was still on the hook for someone else.

1. Does the credit bureau report everything, or just the stuff that isn't being paid off? And can you actually see if someone is acting as a co-signer?
2. When did this whole credit reporting system start?

She did exactly that and got the loan. I'm thinking—could that mean the old co-signing thing never actually went through? I doubt they'd give her a loan if she was still tied to someone else's debt.

Since there’s no real way to fight it now, things are actually looking up. I’m stuck between paying the bill outright or just letting them freeze my checking account and take it from there. I really don't want to end up in that nightmare scenario where you pay everything off, but they freeze your account anyway and pull the money a second time! That happened to two of my coworkers—they eventually got their money back, but man, it was such a huge headache...

Once I catch up with him, I’ll get the full scoop. But if I'm reading him right, the contract wasn't even in his personal name—it was under his LLC. Since he sold the business and stepped down, he probably figured that closed the loop. Honestly... I’d be just as tripped up if I were in his shoes.

But, wouldn't it make sense (speaking as a total amateur here) to file an appeal? Like, show them the paperwork proving he wasn't the owner anymore, so VIP could just redirect the collection to the new owner instead?

If they actually approve it, please post an update here so we all know (you never know)... though honestly, I think your odds of getting a refund are lower than your odds of hitting the Powerball.

A coworker of mine actually got her money back for something she wasn't even supposed to withdraw (related to childcare stuff). She had to play hardball and bug them constantly over the phone, but hey, she got it back! 😉

Quick question about VIP

So, a buddy of mine sold his small business back on March 17, 2011, and included a clause stating all debts would transfer to the new owner. Well, yesterday he gets hit with a collection notice from VIP for several unpaid bills dating from March 19, 2011, onwards.
He’s not saying he doesn't owe the money, but he thinks—and I'm inclined to agree—that they've got the wrong guy. Those charges popped up after the sale, so they should be hitting the new owner's doorstep, not his.
My advice to him was to fight the collection immediately to stop them from grabbing his cash, then deal with the proof later. If they drain his bank account now, I doubt he'll ever see a dime from the new owner.
Any tips or advice is welcome!
