Hi there. A buddy and I were recently picked up by the police regarding the exact same criminal charge—Section 263. We were together when it all went down, of course, so we both had to give statements that were subsequently handed over to the District Attorney's office. Personally, I managed to put together a fairly solid defense, whereas he... well, let's just say he spent his time talking nonsense (I won't get into the specifics of his rambling right now). The trial has officially kicked off, but interestingly enough, I wasn't summoned for the first hearing—it was just him and perhaps a few witnesses. My question is: why wouldn't they call me if I'm also a defendant? Is it possible the prosecution is handling our cases separately, or am I missing something else entirely?

If you both are legal adults, then there isn't an active criminal case being filed against you personally—and if someone actually filed a formal complaint, you should have already received a notice of dismissal. Now, if one of you is a minor, the legal process handles that through a separate juvenile proceeding. It’s honestly pretty strange that you haven't been called in as a witness yet. Honestly, if you want total peace of mind, your best bet is to just head down to the District Attorney's office and check things out in person.

-Thanks for the input. He and I are both adults. It feels weird that I haven't received a subpoena or any kind of court summons, especially since I technically confessed to the crime—albeit in a rather subtle way. I'm not entirely sure how the DA's office interpreted my statement. There's also the possibility that this whole... mess regarding the alleged court summons he supposedly received might just be nonsense.
