Thomas Miller80 said:Look, you don't do a single thing right now. This is just a notice from the cops—maybe they show up, maybe they don't

If they do come knocking, they’ll hit you with a citation for this and that, telling you to pay it there

But don't actually pay it. Instead, within the window they give you—I think it's like 8 days—you file an appeal. Only then does it head to court. And man, that takes forever—by the time you get a summons, half the statute of limitations has already evaporated

So, sit tight. Don't do anything. Absolutely nothing

Just wait

I'm telling you from experience here. I've had 12 different citations—a few from fender benders, all of them eventually expired. I never paid a dime, and my driver's license record is still spotless

Trust me on this one

Because if you go ahead and file that appeal now, you're basically admitting you were actually there—even if that appeal doesn't mean much in front of a judge, it makes it obvious you're just playing games

Do exactly what I told you, and the only cost to you will be buying me a plate of sliders and a couple of beers

Forget the theorists—I'm a man of action

Honestly, I am totally lost here
So you get a citation, and then when "the other thing" finally arrives, you'll probably get a bill in the mail😕
What kind of appeal are you even supposed to file for that?
No, seriously, I'm curious—did you read all this somewhere else? Because the way you're explaining it makes zero sense to me

I mean, he probably knows what's up, since he's actually out there doing the work on the ground😎 😉

If it does arrive, they’ll list the specific fine for whatever violation occurred, and they'll tell you to pay it right there.

But don't just pay it. Wait until the very last possible second—like that 8-day window they usually give you—and then file your appeal. Only then does it actually head to the courts. That process takes an absolute eternity; by the time you get a summons to appear, half the statute of limitations has already evaporated.

Right now, you do nothing. Absolutely nothing.

I'm telling you this from firsthand experience. I've had twelve different citations, a few from fender benders, and every single one of them hit the statute of limitations. I never paid a dime, and I don't have a single point on my license.

Trust me on this.

If you go ahead and file an appeal right this second, you're basically admitting you were actually there (even if that appeal doesn't carry much weight in court anyway, it just makes it obvious you're trying to wiggle out of it).

Do exactly what I told you, and the only thing you'll owe me is a plate of BBQ ribs and a couple of cold beers.🙂

Forget the theorists; I'm a man of action.

Man, you are totally full of it... ☕

It’s a completely different ballgame if they hand you a citation right there on the spot versus when it shows up in the mail from the local police department weeks later...

So yeah, just go ahead and file an appeal... 😉

Michael Perez5 said:I just want them to tell me what happens if I end up missing that initial deadline to file an appeal

There isn't really a "first" deadline, there's just one single window 🙂
and if you let that slip by, you're looking at exactly what Thomas Miller80 mentioned earlier... basically, they move straight to enforcing the penalty

Michael Perez5 said:I'm with you on that 😁 alright... let's just wait for Laura 🙂

you really want me to go over everything one more time? 😁
Traffic violation procedures in Criminal and Misdemeanor Law ·
Thomas Miller80 said:Michael Perez5, you're filing an objection without providing any reasoning!
so just cut out that last paragraph 😉

after that, they kick off the misdemeanor proceedings—meaning they'll summon you to a hearing. That's where you can explain yourself as much as you want. If you have evidence you want to present (like asking to cross-examine an officer and the court actually grants it), they'll schedule another hearing. Eventually, the court will hand down a decision, which you can appeal to the higher appellate court within a specific timeframe (I think it's 8 or 15 days from when you get it, I can't remember the exact rule right now).
Hopefully the process makes sense now, though I feel like I've explained this "correctly" at least four times already—not to mention how many times Laura, crimsonsailor7, or Jack 😬
have had to hear it. Whether or not the statute of limitations kicks in? Nobody can tell you that. It all depends on how fast they schedule your hearings—some judges stay on top of things, while others are either totally swamped or just plain lazy 😁

Anyway, good luck 😉

I honestly think we should just start a dedicated sub-forum specifically for rule violations, and then pin the official guide on how to file appeals right at the top as the main thread 😁

because man, we're all just sounding like broken records at this point, repeating the exact same stuff over and over again... 🙂 😬

I honestly can't wrap my head around how some people actually pull this off. Take my friend, for example. He’s the type who always has his foot heavy on the pedal. We were driving through a coastal town in California—the kind of place where you know the local police hide behind bushes just waiting to catch someone with a handheld radar gun. He cruises right into a residential zone 60 miles/h, even though the limit is clearly 31 miles/h. I’m sitting there, suppressing a smirk because I think he’s finally getting caught, when I hear the officer start reciting the standard speeding penalties 😲. Then, my friend starts spinning this ridiculous web of excuses: "I'm unemployed," (lie), "I'm living on welfare $93," "This car was a gift from a sponsor for my amateur handball league," and "I lost my hearing in the war" (he has some hearing loss, sure, but he's claiming it's combat-related). I 😕 just stared at the cop, wondering if he was actually going to buy this nonsense. Instead, the officer visibly swallowed hard, handed back my friend's documents, and told him, "Just slow down, okay?"

People like that truly 🙏 🙏 🙏 🙏 🙏 🙏 🙏

🙄 🙄 🙄 🙄
they’re gonna get a massive reality check when some smart-ass kid finally catches them red-handed, because let's be real, kids these days are way too sharp to actually bother following the rules... 🙄

if you're gonna go out of your way to hide a violation, then just be a badass and own the consequences when they come knocking.

Austin Martinez2 said:Maybe you missed the fact that those controversial terms were in quotation marks? Please, interpret them that way instead of taking everything so literally.
I still maintain my stance: citizens are the ones who hold the responsibility. After all, who else builds and sustains a nation if not its people?
Honestly, I'm surprised phrases like "...it's a joke" even fly in a discussion like this.😕
crimsonsailor7.....The fairness of the statute of limitations itself isn't the issue. The problem is how it's applied and interpreted.
...What the person was really asking was how to best dodge a penalty. While I totally get the fear and discomfort involved, the law has a specific stance on that—and maybe even a moral one. Some people could really use a refresher course on Civil law...🙄 (..or just ask someone who actually understands it.)

honestly, some people really shouldn't be out here acting like legal philosophers when they clearly don't have a clue😉

Austin Martinez2 said:Don’t take this personally, but seriously... it’s no mystery why our country ends up in this state when everyone is constantly hunting for "loopholes" and "statutes of limitations." As long as those gaps exist, people are going to act exactly like you—completely irresponsible. And then, they have the nerve to complain about the consequences.😎

Look, I'm not saying people aren't acting irresponsibly, but the whole concept of a statute of limitations isn't just some random thing we made up out of thin air, it actually exists for some pretty valid reasons...
Double major? in Law ·
I’ve got no clue how things are looking over in Bologna, but from what I’ve seen so far, you could basically only get a degree fully covered by the Department for one specific major...
What you pull off at one university doesn't really carry over to the next one either.
At best, if the fields of study are somewhat related, they might give you credit for a few exams you've already passed, but that's about it...
Matthew King9 said:If that's the case, why does the law state they belong to the first tier😉?
And then list siblings and their spouses in the second?

I guess it's gonna take you a little longer to wrap your head around how probate works😬 man... 😉

silentgardener3 said:Correct me if I'm wrong, but my understanding is that once a lawsuit actually kicks off, the statute of limitations stops running. Here’s my reasoning:

The statute of limitations effectively bars someone from demanding an obligation be met. It kicks in once the legally defined period passes during which a creditor could have sought fulfillment. Keep in mind, though, a court won't consider the statute of limitations unless the defendant specifically raises it as a defense.

Unless specific laws dictate otherwise, the clock starts ticking the day after the creditor first had the right to demand payment. If the obligation involves refraining from doing something—like avoiding a certain action or omission—the countdown begins the day after the debtor violates that agreement.

man, I really hope you aren't right about that 😁
I honestly feel like you can really dial back on the tablets if you need to... it’s totally fine. There's really no reason to stress out about it...

I honestly don't know how people deal with all this constant noise lately... it just feels like everything is getting louder and more chaotic by the second, and I'm just sitting here trying to find some kind of footing while everyone else seems to be sprinting in circles... turns out, staying level-headed is way harder than it looks when the world decides to go completely off the rails... anyway, just my two cents... kaže:
Applying pure lavender essential oil—or even aloe vera—directly to your skin like that... I don't know, man, you gotta be really careful with that... some people swear by it, but if you aren't diluting those oils properly, you might end up with a nasty reaction or a burn instead of feeling relaxed... it's probably safer to mix it with a carrier oil first, just to be on the safe side...🙂

Honestly, tea tree oil works just as well...

Just head down to the pharmacy and pick some up.
A buddy of mine was telling me he used it before, and he said it’s pretty incredible how much fat it just flushes right out of your system, though honestly, it’s kind of a nightmare because you end up leaving a greasy mess in the toilet bowl every single time... 🤣

Nah, you came here specifically looking for ways to push back your period 🙂...

😕

I remember trying that exact same thing back when I was maybe fifteen or sixteen, just hanging out at the beach for summer break... I started taking them about seven days before my period was supposed to hit, and everything went totally normal, like nothing even happened...

And I can see you're looking at all this stuff like it’s pretty much harmless... between the birth control and the "morning after" options and everything else. Just please, don't go playing around too much with that side of things...
Period talk: Questions and advice in Women's Health ·
I’m not totally sold on that method, but hey, at the end of the day, it’s your body 😳
it won't really kick in if you just start popping them a few days before your period hits, you actually have to start on the very first day of your cycle, keep going all month, and then when you hit that week where you're supposed to take a break, that's when you crack open a new pack.

As for what the lady 😬 at those pharmacies that don't bother asking for a prescription said... it isn't even about them being super thorough or anything, they just hand the pills out, especially to younger girls, mostly because it saves them from having to deal with everyone coming back later for the emergency contraceptive... I've had several people tell me that's how it works...

amberbadger97 said:no... does it say they'll issue a default judgmentOR will the decision be made in absentia if the defendant's presence isn't required? Like, under what specific circumstances is it okay for them to just decide without you being there???

look, your presence isn't actually mandatory if the court feels like they've got enough evidence on hand to rule on a misdemeanor... honestly though, it’s probably better to just show up and take your lumps...😁
Traffic violation procedures in Criminal and Misdemeanor Law ·
amberbadger97 said:They’re saying they can just wrap this whole thing up without me showing up if my presence isn't strictly required under Section 130, but then they mention bringing me in by force if I don't show? I'm honestly pretty confused about how that works...

Section 130.

(1) Aside from the details covered in Section 129, subsections 2 and 3 of this Act, the summons sent to the defendant includes notice regarding the specific violation being charged, a warning that they are required to appear in person, and a warning that if they fail to appear, a warrant will be issued or, if the defendant's presence isn't deemed necessary for the hearing before the municipal court, a decision may be reached in their absence.

Does that make more sense now?... 🙂

Yeah, I am officially joining this club. My head is throbbing, I’m totally wiped out, my blood pressure is tanking, and my focus is just non-existent—which is honestly kind of great when I'm staring down a massive deadline 🙄
A little neck massage helps a bit, and I've been leaning on aspirin and Vitamin C, but I haven't stumbled upon any permanent or actually effective fix yet...
