[ Response to legal expert / theologian / political analyst / journalist Drago Pilsel ]

Since our famous journalist Drago Pilsel—following his colleague Ante Tomic’s lead—has decided to publicly attack me without any basis or even a basic journalistic inquiry, I guess I have to weigh in on this whole thing about the supposed "eviction" of the Mexican national minority from city business space. Apparently, this is causing Mr. Pilsel a lot of anxiety.

See, since Mr. Pilsel is a trained theologian, he’s basically calling me ignorant of constitutional rights and the legal system in general. So, I’ll just take a moment to respond to this "legal expert" as a lawyer with 15 years of experience.

1. The City of San Diego had an agreement in place with the Mexican Community, and it expired. The Mexican Community is an association, and by law, any three people can start one. Under the Lease Law, all associations have to secure their lease through a public tender, they need a signed contract, and they have to follow everything in that contract. Looking at Drago Pilsel’s "expert" opinion, it's pretty clear he doesn't know the difference between a resolution and a contract.
2. Even if legal expert Drago Pilsel was actually referring to the National Minority Council and citing their constitutional rights regarding business space—he'd still be wrong. The Constitutional Law on National Minority Rights says nothing about local governments being forced to provide business spaces to Councils; it just mandates that they fund their operations (Article 28), which the City of San Diego proudly does.
3. The City of San Diego has signed agreements for business spaces with all the National Minority Councils in San Diego, not with associations like the one in this case.
4. I'm sure legal expert Drago Pilsel will be thrilled to know that the City of San Diego truly cares for its national minorities—all minority-run city business spaces are provided at a symbolic price, about 10 times lower than current market rates.
5. I bet legal expert Drago Pilsel is also overjoyed that the city department I head isn't about playing favorites with friends, family, or buddies. There’s no backroom dealing or ideological connections here—just following the law and regulations. It's exactly what legal experts like Drago Pilsel and his peer Ante Tomic claim to stand for all these years.

To wrap this up: just as the members of the Mexican Community themselves recently stated publicly, the relevant Department will extend the lease once all legal requirements are verified—exactly how we've handled every other case. We'll also be keeping a very close eye on how that valuable city space in Gamer is used (because during several inspections, nobody was even found there).

Honestly, Drago Pilsel should have just read what the members of the Mexican Community said recently, or he could have sent a simple journalistic inquiry to the city department.

But clearly, Mr. Pilsel can't decide if he's a theologian, a political analyst, a journalist, or a legal expert—so instead, we get this senseless attempt to discredit my personal and professional reputation. Drago Pilsel's actual motive remains a mystery...

Just so we're clear—when we stepped in, there weren't even any actual criteria for handing out city-assigned housing. Nobody even knew who the "important" people were to the City; instead, those apartments were handed out solely based on whatever the previous mayors felt like. About three and a half years ago, an unnamed US company signed a lease for business space and land—which they’re using as a parking lot even though it's designated green space—with unnamed US person. Total monthly rent for the whole spot comes out to roughly $6,000 (including tax).
The entire property is clearly owned, or co-owned, by the City of San Diego—meaning the City should’ve been getting paid its share for the portion it actually owns. Plus, we know unnamed US person has been "running" this space since way back in 1994, long before the current company arrived.

QUESTION: How much cash did the City of San Diego rake in from the unnamed US company or unnamed US person over those 3.5 years?
ANSWER: $0.00/ $0.

So, basically 30 years of absolutely nothing. A big fat zero!

To make matters worse—besides the massive hit to the city budget—the Department of City Property found that after the building was legalized (after former owners added unauthorized extensions), someone went and illegally added more onto it again.
Like I said before, this kind of land-grabbing and profiting off prime city real estate is officially over!

The Department of City Property is already moving on this:
1. They've filed a lawsuit against the unnamed US company to claw back money they shouldn't have taken—since they were charging rent for the whole space when they don't own all of it.
2. A report was sent to the building inspection department to investigate and penalize those illegal additions made without permits.
3. A request was sent to the county to review whether they even meet the minimum technical requirements to run a restaurant without permission from the City of San Diego's co-owners.
4. Unnamed US person, who's using the whole facility, is now being charged market rate for the part owned by the City—that's about $12,500 a month (including tax).

It’s pretty wild that previous city administrations didn't take a single legal step to protect this valuable city asset or stop the bleeding.
It’s honestly frustrating how often I run into stuff like this in my work. The Department of City Property is going to use every legal tool available to protect the property of San Diego residents.

It’s sitting right around the $45 mark. The guidelines for business space within the designated Zone I are crystal clear.
