Keith Nguyen7 said:The saga continues. My coworker went to check today to see if any actual charges had been filed yet. So far? Absolutely nothing in the system. All we can find is some speeding ticket from back in October that’s just sitting there waiting for a judge—I only even looked up how to file an appeal just to see what the process was like. If nothing has popped up since last Friday, I doubt anything ever will. Seriously though, what the hell is even happening?😲

Oh, so they just took your name down and called it a day...

You can't charge someone with speeding without actual evidence...

Just wrote it down? How is he gonna cite him if there isn't an official report? That guy's a total joke.

Keith Nguyen7, I’m reading your two pathetic posts and my eyes actually hurt 😲

Seriously, the grammar?

I mean, you’re supposed to actually finish some school before getting a driver's license, right?😬

Signs don't have apostrophes, Thomas Miller80! Have you ever even seen an apostrophe on a sign?

The constant, repetitive nagging about how I need to fix my driving habits
so he just turned away without saying a single word
What’s he gonna do, write me a ticket?

I was thinking more along the lines of elementary school training—but hey, whatever☕

Besides, I can't even find a single word with an apostrophe in it😁

Fair enough. I guess I was one of those geniuses who skipped grades, so maybe I skipped that part too? 😉

So, my brother basically wrecked his car on the interstate a few months back. He lost control and just totaled it. There were two of us in the car—him and some girl. Long story short, he was hammered. His BAC was sitting at 0.16, which is insane, and he was flying down the highway doing over 110 mph. Since he’s a brand-new driver, he had those strict curfew laws where he wasn't supposed to be behind the wheel after 11 PM, but the crash happened right around midnight. What kind of damage are we looking at legally here? Is he just going to get slapped with a massive fine, or is he actually looking at jail time or losing his license for good?

You're looking at fines, losing your license, and points on your record... all of the above.

If you’re caught with alcohol in your system, you’re looking at $667, a three-month suspension, and three points gone... plus, if you’re cited for reckless driving because you caused an accident, throw in $333 on top of that. Then there's the late-night driving surcharge—maybe $500 or whatever the local statute dictates—not to mention the extra costs for the breathalyzer tests and the whole legal processing mess, which could easily run you another couple hundred bucks...

Oh, and don't forget: if your insurance company ends up paying out a claim to someone else because of you, they aren't just going to eat that cost; they'll come after the driver to get every cent back since you were driving under the influence...

Look, if he was "making a U-turn"—meaning he crossed that solid double line in any capacity—every single judge in this country is going to rule against him, period.

What am I supposed to do, photocopy my bus pass???

What actually happens if I just don't show up?

Either the cops will come pick you up, or the Court is just going to make a ruling without you even being in the room, basically assuming you’re pleading not guilty but just decided to play hard to get by waiting until tomorrow...

Since they already have the signed delivery receipt back in their hands, you can't just pretend the summons doesn't exist, and any Court is going to view that as a perfectly legal notification unless you can somehow prove otherwise...

Were there any fatalities or serious injuries involved?

It all depends on the specific mix of circumstances—you didn't really lay out the details... but if we're talking loose estimates, maybe just some fines or probation, assuming he hasn't been caught up in this kind of thing before.

The short version: speeding violation on March 30, 2006. Fine was $167 plus costs totaling $37. I filed an appeal within the 8-day window. I received a summons for Court in April 2007 and submitted a written response. Then, just 15 days before the hearing, I got a notice for a discussion. I attended, but it felt like a complete circus. Today, I received the expected ruling finding me guilty, but the payment slip isn't for $610—it's for $233. To make matters worse, there is a stamp stating I must return it to the Court within 3 days.
Legal recourse: there is an 8-day window to appeal to Visa in Washington, D.C. I plan to write and mail the appeal this Monday. I am looking for comments from anyone with experience—what are the odds this reaches the statute of limitations if it expires on April 1, 2008, considering the sheer volume of cases hitting New York City daily? Still, many people claim they receive a confirmation of guilt from Visa even months after the statute has passed (noting on the decision that it was allegedly issued before expiration), which ruins any 😢
. In my view, if the Court operates on this principle, it is peak insolence. If they reached a decision, say, in April, but don't deliver it until October, that level of incompetence is a blatant fraud. They likely finalized everything a few days before mailing it and simply backdated it. Please share your thoughts or experiences.

Based on my experience dealing with misdemeanor proceedings, there’s a common pattern where the municipal court manages to issue a ruling before the statute of limitations actually expires—even if they don't mail it out to the defendant until after the deadline has passed. In those cases, the defendant technically receives the notice after the clock has run out, but the court treats it as timely. It’s a pretty effective little loophole they use to dodge expiration claims.
That’s why I think you really have to push for the statute of limitations to lapse before they even get around to issuing that first-instance decision. Honestly, there are plenty of ways and legal maneuvers to drag out the process just enough to make sure that happens before any final ruling is handed down.

So, I ended up getting slapped with a violation under Section 53, Paragraph 6 of the Traffic Safety Act back on June 6, 2006. I filed an appeal, and then I had to show up in Court on November 30, 2007. Now I’m sitting here wondering what the statute of limitations looks like for something like this, and honestly, what are my actual odds of getting it tossed via the Supreme Court if I decide to push the appeal further?

The statute of limitations is two years from when it actually happened, so your chances really depend on the specifics... and just so you know, we aren't talking about the Supreme Court here, just a high-level trial Court.
